Jules et Jim by François Truffaut or the Unbearable Lightness of the Feminine. Truffaut’s movie Jules et Jim (« Jules and Jim ») is an intimist movie but also a fresco of Europe throughout the first half of the 20th century, as it was torn apart by the two world wars and Nazism. At the same time, the film tells the story of the friendship that began during the Belle Epoque between two intellectuals, a French (Jim) and a German (Jules), (...) both madly in love with an English teacher (Catherine). In the insular tradition of the Elizabethan theatre, this is a story about love, treason, jealousy, hate, and finally murder and suicide. In its structure, it is a mix of farce, sentimental drama turned into tragedy, and which in the end reveals itself as a comedy of errors, with, nevertheless, very serious themes: love and war, desire and drives, femininity, maternity and semblance, competition between men for a woman etc. This movie brilliantly represents the Nouvelle vague and is a proof that Freud and Lacan were right when they established once and for all that the unconscious is a fundamental and necessary scene. Human destiny is set and its mysterious scripts are played out - from sexuality to death, from Eros to Thanatos - as the subject’s fantasy, the window through which he or she tackles reality. Mihaela Miroiu, The road towards autonomy. Feminist Political Theories Polirom, Iasi, 2004.

With this nuanced and interdisciplinary work, political theorist Mihaela Mihai tackles several interrelated questions: How do societies remember histories of systemic violence? Who is excluded from such histories' cast of characters? And what are the political costs of selective remembering in the present? Building on insights from political theory, social epistemology, and feminist and critical race theory, Mihai argues that a double erasure often structures hegemonic narratives of complex violence: of widespread, heterogeneous complicity and of "impure" resistances, not easily (...) subsumed to exceptionalist heroic models. In dialogue with care ethicists and philosophers of art, she then suggests that such narrative reductionism can be disrupted aesthetically through practices of "mnemonic care," that is, through the hermeneutical labor that critical artists deliver—thematically and formally—within communities' space of meaning. Empirically, the book examines both consecrated and marginalized artists who tackled the memory of Vichy France, communist Romania, and apartheid South Africa. Despite their specificities, these contexts present us with an opportunity to analyze similar mnemonic dynamics and to recognize the political impact of dissenting artistic production. Crossing disciplinary boundaries, the book intervenes in debates over collective responsibility, historical injustice, and the aesthetics of violence within political theory, memory studies, social epistemology, and transitional justice. An investigation of criminal attempts unearths some of the most fundamental, intriguing and perplexing questions about criminal law and its place in human action. When does attempting begin? What is the relationship between attempting and intending? Do we always attempt the possible and, if so, possible to whom? Does attempting involve action and does action involve attempting? Is my attempt fixed by me or can another perspective reveal what it is? How 'much' action is needed for an attempt, how 'much' (...) intention is needed and can these matters be decided categorically? Bebhinn Donnelly-Lazarov's answers to these questions will interest criminal law theorists, philosophers and lawyers or law reformers, who encounter the mixed practical and philosophical phenomenon of attempting. Inspired by G. E. M. Anscombe's philosophy, Part I examines attempting generally and its relationship with intention, action subjectivity, and possibility. During the last decade there has been burgeoning research concerning the ways in which we should think of and apply the concept of responsibility for Artificial Intelligence. Despite this conceptual richness, there is still a lack of consensus regarding what Responsible AI entails on both conceptual and practical levels. The aim of this paper is to connect the ethical dimension of responsibility in Responsible AI with Aristotelian virtue ethics, where notions of context and dianoetic virtues play a grounding role for (...) the concept of moral responsibility. The paper starts by highlighting the important difficulties in assigning responsibility to either technologies themselves or to their developers. Top-down and bottom-up approaches to moral responsibility are then contrasted, as we explore how they could inform debates about Responsible AI. We highlight the limits of the former ethical approaches and build the case for classical Aristotelian virtue ethics. We show that two building blocks of Aristotle’s ethics, dianoetic virtues and the context of actions, although largely ignored in the literature, can shed light on how we could think of moral responsibility for both AI and humans. We end by exploring the practical implications of this particular understanding of moral responsibility along the triadic dimensions of ethics by design, ethics in design and ethics for designers. Deep learning AI systems have proven a wide capacity to take over human-related activities such as car driving, medical diagnosing, or elderly care, often displaying behaviour with unpredictable consequences, including negative ones. This has raised the question whether highly autonomous AI may qualify as morally responsible agents. In this article, we develop a set of four conditions that an entity needs to meet in order to be ascribed moral responsibility, by drawing on Aristotelian ethics and contemporary philosophical research. We encode (...) these conditions and generate a flowchart that we call the Moral Responsibility Test. This test can be used as a tool both to evaluate whether an entity is a morally responsible agent and to inform human moral decision-making over the influencing variables of the context of action. We apply the test to the case of Artificial Moral Advisors and conclude that this form of AI cannot qualify as morally responsible agents. We further discuss the implications for the use of AMAs as moral enhancement and show that using AMAs to offload human responsibility is inadequate. We argue instead that AMAs could morally enhance users if they are interpreted as enablers for moral knowledge of the contextual variables surrounding human moral decision-making, with the implication that such a use might actually enlarge human moral responsibility. Intention is at the heart of criminal law. If it is not the mens rea requirement found most often in offences, it is still the standard against which other grades of fault tend relatively to be judged. It has generated much controversy, as the crucial question, “Did the defendant intend X?” is resistant to clear answers. This essay’s starting point is Judith Shklar’ diagnosis of a pathology marring democratic societies: complex injustices passing as “misfortunes” that nobody feels responsible for. I propose that denunciations can reveal the political nature of the suffering that everyone conveniently ignores, thus advancing democratic accountability. While denunciations can target various invisible injustices and take many forms, this essay deals with the case of societies with an unmastered past of violence. In order to avoid taking responsibility for the plight of victims, the (...) past is often redescribed in the language of “catastrophe” or “necessity.” Building on Hannah Arendt’s views on spectatorship and storytelling, this essay analyses theatrical denunciations addressing the wider community. Theatre—professional or amateur—can repoliticise neutralised areas of social interaction and transform passive onlookers into reflective spectators. The Argentinean performance of escraches and Thomas Bernhard’s play Heldenplatz are discussed as examples of successful political denunciations communicated in dramaturgical form. (shrink)

The present study was motivated by the hypothesis that inputs from internal states in obsessive–compulsive individuals are attenuated, which could be one source of the pervasive doubting and checking in OCD. Participants who were high or low in OC tendencies were asked to produce specific levels of muscle tension with and without biofeedback, and their accuracy in producing the required muscle tension levels was assessed. As predicted, high OC participants performed more poorly than low OC participants on this task when (...) biofeedback was not available. When biofeedback was provided, the difference between the groups was eliminated, and withdrawing the monitor again reversed this effect. Finally, when given the opportunity, high OC participants were more likely than low OC participants to request biofeedback. These results suggest that doubt in OCD may be grounded in a real and general deficiency in accessing internal states. (shrink)

Law as a Claim-Maker: A review of Stefano Bertea, The Normative Claim of Law.

Jurisprudential debate about the grounds of law often focuses on the status of morality. Given the undoubted fact of judicial engagement with morality in legal reasoning, the key question is whether morality legitimately counts as a ground of law. This article seeks to challenge the special status accorded to morality in debates about the grounds of law. The claim I seek to advance is that very often judicial engagement with morality is not different in kind to judicial engagement with other (...) diverse objects of legal reasoning. What the comparison tends to show is that instances of “moral reasoning” in law do not obviously challenge our account of the grounds of law. Rather these instances can be viewed as central case examples of legal reasoning. Conventional grounds of law are left untouched. (shrink)

The topic of the essay is the “explanatory gap” between, on one side, descriptions of conscious states from 1st person perspective, termed as phenomenal consciousness; and on the other side, the descriptions of conscious states in representational theories of mind, from 3rd person perspective, termed as access consciousness. The main source of the explanatory gap between P-consciousness and A-consciousness is the methodology of functionalism, accepted in almost contemporary representational theories. I argue for the following: The principles of materialist ontology, accepted (...) in representational theories of mind, are true. But materialism is not necessary linked with functionalist research methods. The only reasonable consequence from the existence of the “explanatory gap” is that functionalism should be replaced with more adequate methodological approaches. One such non-functionalist approach, termed as “aesthesionomic approach”, is proposed. The central idea is that phenomenal conscious states should be first described in objective terms . Only on base of such a preliminary objective description of phenomenal conscious states, the description of representational mechanisms will not give rise to an “explanatory gap”. (shrink)

This article is a study of three major metaphors organizing nationalistic discourse about Cyprus in two online forums for Turkish university students. The analysis suggests that discussants symbolically warranted their constructions of the future of Cyprus and Turkish Cypriots with metaphors of blood and heroism that emphasized their personal and collective memory of sacrifice. Sports metaphors were used predominantly to convey a sense of the strategic importance of Cyprus. In addition, discussants employed gender and sexual metaphors to structure the tension (...) between nationalist feelings associated with motherland Turkey as a pure, virgin female, and the geopolitical demands of the nation-state, portrayed as a father faced with uneasy choices. This study explored the influence of healthcare ageism on nurses’ moral distress. Episodic interviews were conducted on 25 Romanian nurses in 2020. Thematic analysis revealed that all moral distress sources reported reflected macro-, meso- and micro-level ageism, benevolent and hostile, self- or other-directed, including stereotyping, prejudice, and discrimination of older patients. The COVID-19 pandemic-related ageist measures increased healthcare ageism and transformed nurses’ representations of older patients accordingly. Nurses felt moral conflict both when passively witnessing ageist acts and when perpetrating them (...) to adhere to group norms, highlighting the need to combat ageism for both patients’ and nurses’ well-being. From the semantic perspective, the religious language is rooted in a preexisting extra-linguistic referent, which eludes historic space-time categories, in an attempt to build a world of transcendental essence and establish a relationship between man and (...) the sacred. In this view, the word is invested with magical powers, playing the role of a mediator between the human being living in the world of the profane and the sacred world of the Divinity. Since the word embraces the essence of the named element with the power to shape reality, the religious man pays special attention to the verbal expression not only from the desire to adapt to reality, but especially out of the care not to cause adverse changes amidst it. We propose in this paper to review the main religious taboos specific to the religious language and the description of the pragmatic valences that the euphemistic expression manifests in the religious communication. Vehement resentment and indignation are rife in societies emerging from dictatorship or civil conflict. How should institutions deal with these emotions? Arguing for the need to recognize and constructively engage negative public emotions, Mihaela Mihai contributes theoretically to the growing field of transitional justice. Drawing on an extensive philosophical literature and case studies of democratic transitions in South Africa, South America, and Eastern Europe, her book rescues negative emotions from their bad reputation and highlights the obstacles and the opportunities (...) such emotions create for democracy. By valorizing negative emotions, either through the judicial review of transitional justice bills or the criminal trials of victimizers, institutions realize the value of respect and concern for all while contributing to a public culture hospitable to democracy. In this paper I investigate, from an ethical perspective, the legal prospects of unrelated living donors from Romania. In the present-day shortage of organs necessary for transplantation, the organs from living donors represent an alternative to the organs from deceased ones. Worldwide, unrelated living donors begin to be considered as a promising category among overall living donors. However, their situation raises many ethical questions that need to be addressed by adequate regulations and protections. Ever wonder if it is possible to construct a numeric scale for environmental variables, like one does for the temperature? This paper is an attempt to construct one. There are two main parts: section “Statistical Analysis of Variations” presents a general statistical strategy for environmental factor selection. Section “Nonlinear Analytical Geometric Model of Variations” develops an analytical geometric representation of system variations in response to environmental changes. The model is used to quantify the effects of environmental interactions. The paper treats (...) only one-dimensional case, however, the derivation of the case of multiple independent factors follows immediately. The general method developed in this paper may prove applicable to many different fields, such as extensions beyond classical physics, economics, and other sciences. This conference follows the “traditional” poetics of many Romanian feminist discourses: warning, justification, and body proper. After introducing new proofs about the necessity of feminist discourse in present-day Romania, the conference deploys the body of the conference proper. The conference has two main sections, constructed symmetrically according to the distance/proximity principle, which argue for the specific position of Romanian feminism among contemporary feminisms.

For twenty years, the European Union has qualified as a supranational actor more and more present on the educational scene. Through the European strategies - Lisbon 2010 and Europe 2020 - but also the open method of coordination, an essential mutation has been occurring at the level of Member States. In this article, I intend to analyse in which manner the European Union manages to become a genuine educational actor. Thematic analysis of forty semi-structured interviews conducted with European and international (...) officials demonstrate that the European leaders prepared the European “suitcase” for the first “flight” of 2010 and the second one in 2020. Mainly, this briefcase regroups benchmarks, core competencies, mobility programs and the European qualifications framework. If the European Union is able to “boast” with a national or international political visibility through educational proposals however, an unknown factor remains in this geopolitical equation. In an effort to delineate a more plausible account of political change, this paper reads Pierre Bourdieu’s social theory as a corrective to exaggerated enthusiasm about the emancipatory force of reflection. This revised account valorizes both Bourdieu’s insights into the acquired, embodied, durable nature of the political habitus and judgment theorists’ trust in individuals’ reflection as a perpetual force of novelty and spontaneity in the public sphere of democratic societies. The main purpose of this exercise is to reveal the mix (...) of continuity and discontinuity that is characteristic of most transformations in the political common sense of democratic societies. In other words, this paper seeks to offer a more complex understanding of the inertial character of reflective judgment and of the difficulty of shifting the categories that define the political common sense. By cross-pollinating the ever-growing literature on reflective judgment and Bourdieu’s sombre theory of politics, we can better calibrate our expectations regarding the possibilities of significant democratic transformation in late capitalist societies. In this paper, a special type of polysemantic words, that is, words with multiple meanings for the same part of speech, are analyzed under the name of neutrosophic words. These words represent the most dif cult cases for the disambiguation algorithms as they represent the most ambiguous natural language utterances. For approximate their meanings, we developed a semantic representation framework made by means of concepts from neutrosophic theory and entropy measure in which we incorporate sense related data. This paper examines the mechanisms involved in the interpretation of utterances that are both metaphorical and ironical. For example, when uttering 'He's a real number-cruncher' about a total illiterate in maths, the speaker uses a metaphor with an ironic intent. I argue that in such cases both logically and psychologically, the metaphor is prior to irony. I hold that the phenomenon is then one of ironic metaphor, which puts a metaphorical meaning to ironic use, rather than an irony used metaphorically (...) (§1). This result is then used to argue for the claim that in metaphor, it is metaphorical, not literal, meaning that determines the utterance‘s truth conditions. Gricean accounts, which exclude metaphorical meaning from truth conditional content and rely entirely on conversational implicature, are seen to be unsatisfactory. Five contextualist arguments are briefly discussed to the conclusion that metaphorical content is part of truth-conditional content, rather than implicated (§2). (shrink)
